These actions support meaningful participation under IDEA (34 C.F.R. § 300.321; § 300.322) and help ensure that educational decisions are aligned with the student’s right to appropriate services and equal access to educational benefit under Section 504 and the ADA (34 C.F.R. § 104.4; 28 C.F.R. § 35.130).
Parents may take the following steps to support informed and effective participation:
Bring an advocate or support person to meetings, as appropriate, to assist in understanding and addressing decisions
Maintain detailed notes and document key statements and determinations during meetings
Confirm discussions, decisions, and unresolved matters through follow-up written communication
Maintain an organized record of all requests, responses, evaluations, and outcomes
Focus discussions on objective data, measurable progress, and documented evidence
Consistent documentation and written communication ensure that decisions are:
Clearly articulated
Supported by relevant data
Subject to review over time
These practices also help identify patterns, inconsistencies, or gaps in data that may affect the appropriateness of the educational program.
Under Section 504 of the Rehabilitation Act and the Americans with Disabilities Act (ADA), public schools must ensure that students with disabilities are provided an equal opportunity to access and benefit from educational programs and services (34 C.F.R. § 104.4; 28 C.F.R. § 35.130).
