What is a Prior Written Notice (PWN)
Prior Written Notice (PWN) is a required written explanation that a school must provide when it proposes or refuses to initiate or change:
Identification
Evaluation
Educational placement
The provision of Free Appropriate Public Education (FAPE)
Under the Individuals with Disabilities Education Act (IDEA), this requirement is set forth in (34 C.F.R. § 300.503).

PWN provide a clear, detailed explanation of the decision, including:
A description of the action proposed or refused
An explanation of why the agency is taking or refusing the action
The data, evaluations, records, or reports used as the basis for the decision
Other options considered and the reasons those options were rejected
Other relevant factors considered by the agency
A statement that parents have procedural safeguards and how to obtain them
Sources for assistance in understanding these provisions

A vague or incomplete notice does not meet legal requirements.
| Why This Right Matters
Prior Written Notice is one of the most important procedural safeguards available to parents. It creates a clear, written record of the district’s decisions, including the reasoning and data relied upon.
PWN allows parents to:
Fully understand what the district is proposing or refusing
Evaluate whether decisions are supported by appropriate data
Identify gaps, inconsistencies, or unsupported conclusions
Preserve a clear record for future meetings, complaints, or dispute resolution
Without complete and accurate PWN, parents may be unable to participate meaningfully in decision-making.
Failure to provide adequate PWN may constitute a procedural violation and may rise to the level of a denial of a Free Appropriate Public Education (FAPE) if it:
Impedes meaningful parental participation
Results in a loss of educational opportunity

How to Request PWN
When a request is denied, parents may request that the refusal be documented through Prior Written Notice.
A simple request may include:
“Please provide Prior Written Notice for the district’s refusal, including the data and rationale supporting this decision, in accordance with 34 C.F.R. § 300.503.”
PWN should be requested when:
A service or support is denied
An evaluation is refused
A proposed change is not implemented
A decision is made without clear explanation or supporting data
Important Clarification
A public agency may not rely on informal communication (verbal statements, emails, or meeting discussions) in place of required written notice.
If a refusal is communicated informally, parents may request that it be formally documented through PWN.

Impede meaningful parent participation
